What happens if I get a DUI in North Carolina?

In Rockingham County and across North Carolina, driving under the influence is a serious offense. If you already have one or more DUI convictions on your record, your consequences increase tremendously. The breakdown of misdemeanor DUI consequences in North Carolina is as follows:

Level V 

  • A fine of up to $200 

  • A minimum jail sentence of 24 hours, but can be extended up to 60 days

  • Up to 24 hours of community service

  • Driving privileges revoked for up to 30 days

Level IV 

  • A fine of up to $500 

  • A minimum jail sentence of 48 hours, but can be extended to 120 days

  • Up to 48 hours of community service

  • Driving privileges revoked for up to 60 days

Level III 

  • A fine of up to $1,000

  • A minimum jail sentence of 72 hours, but can be extended up to 6 months

  • Up to 72 hours of community service

  • Up to 90 days of driving privileges revoked

Level II 

  • A fine of up to $2,000

  • A minimum of 7 days in jail, but can be extended up to 1 year

  • Substance abuse assessment completion

  • Driver’s license revocation

Level I 

  • A fine of up to $4,000

  • Between 30 days and 2 years in jail 

  • Substance abuse assessment completion

  • Driver’s license revocation

Additional DWI Information

  • If you are a habitual offender with at least 3 DWIs in the last 7 years, you may be facing a Felony DWI. This requires offenders to remain in jail for at least 1 year and complete a substance abuse program either while in jail or while on parole. 

  • If you are under the legal drinking age of 21 years old, you can face criminal charges for having any alcohol in your system. You can even be convicted of drunk driving if you refuse to take a breath or blood test but smell like alcohol.

  • If you refuse a blood or breath test, you will automatically have your driving privileges suspended for 30 days.
